E-Verify Unplanned Outage Has Been Resolved
U.S. Citizenship and Immigration Services (USCIS) announced that the outage, which began at 1:53 p.m. ET January 4 was resolved at 8:06 p.m. ET January 5.
Understanding this temporary state of unavailability to E-Verify may have impacted employer operations, USCIS has implemented the following temporary policies:
- Suspension of the "three-day rule" for E-Verify cases affected by the outage (which does not affect Form I-9, Employment Eligibility Verification requirements). Employers must still complete Form I-9 by the third business day after an employee starts paid work. Likewise, employers must operate in compliance with all other Form I-9 requirements.
- The Tentative Nonconfirmation (TNC) resolution timeline was extended for employees; the days E-Verify was unavailable are not counted toward an employee's timeframe to begin resolving their TNC.
